I. General Provisions

The controller of personal data under Art. 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter the “GDPR”) is Online Imperium, s.r.o.. ID No. 06270671 with registered office at Šeříková 834/50, Brno, Czech Republic (hereinafter the “Controller”).

Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier; or to one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

The Controller has not appointed a Data Protection Officer.
II. Sources and Categories of Processed Personal Data

The Controller processes personal data that you have provided to the Controller or personal data that the Controller obtained on the basis of fulfilling your order.

The Controller processes your identification and contact details and data necessary for the performance of the contract.
III. Legal Ground and Purpose of Processing Personal Data

The legal ground for processing personal data is

the performance of a contract between you and the Controller under Article 6(1)(b) GDPR,

the Controller’s legitimate interest in providing direct marketing (in particular for sending commercial communications and a newsletter) under Article 6(1)(f) GDPR,

your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and a newsletter) under Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the event that no goods or services were ordered.

The purpose of processing personal data is

the handling of your order and the exercise of rights and obligations arising from the contractual relationship between you and the Controller; when placing an order, personal data necessary for the successful handling of the order are required (name and address, contact); the provision of personal data is a necessary requirement for the conclusion and performance of the contract; without the provision of personal data it is not possible to conclude the contract or for it to be performed by the Controller,

sending commercial communications and carrying out other marketing activities.

There is automated individual decision-making by the Controller within the meaning of Article 22 GDPR. You have provided your express consent to such processing.
IV. Data Retention Period

The Controller stores personal data

for the period necessary for the exercise of rights and obligations arising from the contractual relationship between you and the Controller and for the establishment, exercise or defence of claims from these contractual relationships (for a period of 5 years from termination of the contractual relationship),

for the period until consent to the processing of personal data for marketing purposes is withdrawn, for no longer than 5 years, if the personal data are processed on the basis of consent.

After the expiry of the retention period the Controller will delete the personal data.
V. Recipients of Personal Data (the Controller’s Subcontractors)

The recipients of personal data are persons

involved in the delivery of goods / services / execution of payments on the basis of a contract,

providing marketing services.

The Controller intends to transfer personal data to a third country (a country outside the EU) or to an international organisation. The recipients of personal data in third countries are providers of mailing services / cloud services.
VI. Your Rights

the right to withdraw consent to processing in writing or electronically, at the address or email of the Controller specified in Article III of these terms.

You also have the right to lodge a complaint with the Office for Personal Data Protection.
VII. Conditions for Securing Personal Data

The Controller declares that it has taken all appropriate technical and organisational measures to secure personal data.

The Controller has taken technical measures to secure data repositories and repositories of personal data in paper form, in particular by encryption.

The Controller declares that only persons authorised by the Controller have access to personal data.
VIII. Final Provisions

By submitting an order from the online order form you confirm that you have acquainted yourself with the personal data protection terms and that you accept them in their entirety.

You agree with these terms by ticking consent via the online form. By ticking consent you confirm that you have acquainted yourself with the personal data protection terms and that you accept them in their entirety.

The Controller is entitled to change these terms. The new version of the personal data protection terms will be published on the Controller’s website and at the same time the Controller will send the new version of these terms to your email address which you provided to the Controller.
These terms take effect on 27 November 2019.
